You're Forgiven, Not Forgotten

FINALLY, after weeks (if not months) of inner self-struggling, whether or not to start a whole new blog.. And now, here I am!! Starting to talk craps all over again.. haha

The "key-touch" that makes me decide on blogging again is the shocking news i've read this morning.. The possibility of publishing pictures of sex offenders in the newspapers!! The title itself is already shocking enough. I know Australia and UK have this kinda thing over there, but they can manage this thing effectively, can U??

First thing first, why punish them again? If they have completed their legal punishment, they should be given a new life! At least for the first timers, or those who are too young an age. It's OK for those series rapist, though it's still arguable, but, definitely, IF U trust the judiciary part to play their role in punishing crime and restoring justice, then why do the double work?

We all study science, in some part of our lives, rite?? We all know Newton and his law. EVERYTHING exists for a reason. EVERY actions has its effect, be it positive or negative.

Look at the bus accident case in Taiping, where 20 or so had died, because of an idiotic, irresponsible junk of the country.. Again, we can see the weakness in Malaysia's management. It always got to do with management!! We may have the best planning, best infrastructure, best resources, etc BUT, eventually, it was the obsolete in management that failed us.. CAN u imagine the driver, with dozens of traffic summonses in his bill, still can drive like nobody's business on the road!? Also, he had a very bad driving records in his book of "memory". Not long after this, another case at Bukit Gantang, near Taiping (literally means safe and secure in Mandarin). My point is, WHAT is the police doing? can u do your part before intervening other people's role?

Remember u heard people say JPJ (Road Transport Department) requires drivers of all sort to go for refresher courses? health check-up and so? wow!! sounds so effective to curb reckless drivers. then, what happens? shortage of drivers for Raya holiday.. ha ha ha .. then no more news after that..

Malaysia really have to learn from past mistakes man.. Since when only U will understand the effect of taking drastic measures and face the shame of not able to implement it effectively.. Ok, I wont think of raping or committing any crime, since I know the punishment is so heavy.. Rational thinking.. Possessing drugs is deadly rite? Do people still bringing drugs?

You might argue that drugs bring money, people don't care so much in desperation.. But same goes to potential and/or existing rapist.. They got satisfaction from doing it.. Both cases are motivated by fulfilling satisfaction.. Since I will be punished and punished and will never be normal again, will I surrender myself? or kill the victim and play hide-and-seek? I don't care if the rapist is caught eventually or not. But, the victim is surely not able to tell who is who, only dead people wont speak.. besides, U sure u can catch all the rapist? Look at your records man!

Normally in countries where they implement this thing, they have co-operation from society. People make 999 calls and are watchful for each other.. In Malaysia, do you really care? or do you dare to care? No one is brave or stupid enough to go against this decision now.. It means voting for rapist as wrongly perceived by those gullible public.. Take a time or two to think about this issue, is there any way for more effective control in the future? Besides obituary, rapist today! murderer tomorrow! pyramid scheme next week! corruption??? NEVER

Hi zz, a blog to show yr frustration to U ei? keke. I am going to use U, instead of Him, as Him sounds like referring to God. Although I don’t pray, I still would not want to offend Him.

Anyway, i think that publishing sex offenders' picture in the newspaper in not a disaster. The main reason for doing this is not to punish them again, but is for the greater security of the society. I also think it is not against the offender's right to privacy and right to have a normal life again. This is because if they were convicted, their criminal records would already be available to the public domain anyway. But I think these records should only be made available to people who would have an interest in it, e.g. neighbours, instead of to the whole nation, I do not know how this could be done, maybe through the internet where you can search for records of ex-convicts in your neighbourhood. Perhaps, this is the reason U think of publishing it in the newspaper as it would be easier and less cumbersome. Wouldn't you want to know if a previous sex offender is staying right next to you? As a parent or a husband, would you think it is better to know and take precautions or be ignorant and assume that the offender will not commit the crime again? The safety of the society against the rights of the offender, which is more important? Sure there are people who are really remorseful and want to turn a new leaf, but the law could not differentiate such person from the others who will repeat the offence. Neither can you nor I. As you also pointed out (although I don’t totally agree on this), the crimes were committed in order to fulfill the offenders' satisfactions. If a person can commit a crime just for that reason, what makes you think that the person would not do the same just because they have been imprisoned before? I do not know the statistics of repeat offenders. If it is high and totally out of control, I think that this move might be necessary and proportionate to the encroachment of the offenders' rights.

This is also a way to make up for the ineffectiveness of U. Since their records are so bad, what are the chances of a repeat offender committing the offence again and getting away with it in the 2nd time? I don’t know probabilities, but logically speaking, they would be smarter the 2nd time through experience, and the chances of not being caught would be higher. Besides as you say, the punishment is heavy enough, and yet people still commit it. This is a legitimate reason to increase the punishment, by using psychological and traumatic punishment. Again, I think the stats should be considered before such decisions are made, as this also affects the life of offenders who genuinely had changed or want to change. Regarding your statement that this will induce them to repeat the offence, as they know they have no way out, I think this could be true. But would you choose to be condemned by part of the society but could still continue with life (and could still prove that you have changed for real) or go to prison and lose freedom again (and never gain the trust of the society again)? I do not know what a past offender would think, but I would definitely choose the former.

The most important thing here is the balance between the rights of the offenders and the rights of the society to be informed and protected. I acknowledged that the ex-convicts have their rights too, but if they really want to blame, they can only blame themselves for committing it at the first place. Maybe this would even make potential offenders think twice before committing such offence. However, I hope that, should this publishing be implemented, only the name of those that commit the crime AFTER its implementation be published, and not those that committed the crime BEFORE the implementation of the publishing. If this has a retrospective effect, it would be unfair to those who have committed the crime before such implementation, as they did not know that this would be one of the consequences too.

I hope that I make sense in what I have said. Cheers.

wow!! got ppl come to this blogspot de worr.... haha..thx happypig for telling me dat..

thx to JL too, but really, cant make myself finish but anyway,

i believe that PUNISHMENT works exactly the same way as REWARD.. You punish once for each crime committed, reward once for each goodness made

The underlying cause of social illness, particularly the rape case, can very much be dealt with education, especially religious teachings.

All in all, if u believe in rewarding people to promote the goodness he or she has done, or punishing people to discourage certain misdoings, then perhaps we should instill hope and let the positive results we wanted turn out at the end of the day.
